Article 1: Members
- 1. In accordance with the procedures established by Sugi Bee Garden Co., Ltd. ("the Company"), a "member" is defined as an individual who accepts the terms of this Agreement and applies for membership.
- 2. "Member information" refers to information concerning member attributes disclosed by the member to the Company, member transaction history, and other relevant information.
- 3. This Agreement applies to all members and must be observed both during and after registration.
Article 2: Collection of Member data
- 1. We collect the following forms of personal information.
- Name
- Telephone number
- E-mail address
- Shipping address
- Billing address
- Credit/debit card information
The above information is only collected when provided voluntarily by the user.
We automatically obtain the below information.
- IP Address
- Web browser type and version
- Type of operating system
- Type of device
- A list of URLs from the originating page, browsing activity on this site, and last site visited
- Date and time - 2. We collect information when users perform the following actions.
- When searching for this site
- When registering via the membership registration form
- When leaving this site
- When contacting us via the inquiry form
- When subscribing to our e-mail newsletter - 3. Protection of children’s privacy
Given that our services are not intended for children under thirteen years of age, we do not intentionally collect information from individuals under the age of thirteen.
Article 3: Member data management
Under certain conditions, laws on the protection of data grant Members the following rights.
- The right to access one’s personal information
- The right to modify incorrect personal information
- The right to delete personal information, provided it is in compliance with legal obligations
- The right to restrict the handling of personal information
- The right to raise objection to the collection, handling, and/or storage of personal information
Users can log into their accounts to cancel or change the way personal information is used. To exercise these rights, please contact us at the address listed in Article 16.
Article 4: Registration
- 1. Membership qualification
Customers who have submitted the designated application upon accepting the terms of this Agreement are qualified members after having completed the registration process. Membership registration must be completed by the person applying for membership. Registration through an agent is not permitted. In addition, applications will not be accepted that are submitted by individuals who have had their membership qualification revoked in the past or any other individuals determined as unsuitable by the Company. - 2. Entering member information
When entering member information during the registration process, be sure to read the relevant points of note and correctly enter the required items in the designated entry format. Registered member information cannot use special symbols, old-style kanji, or numeric characters. In the event that these have been included in registration information, the Company will change them to another appropriate form. - . Password management
(1) The password can only be used by the member and cannot be transferred or loaned to a third-party.
(2) Members are responsible for managing their password security by, for example, periodically changing it to maintain confidentiality.
(3) A declaration of intent toward the Company that uses a member password is considered a declaration of intent to the Company by the member to whom the password belongs, and the member is responsible for any payments or other obligations arising as a result of such action.
Article 5: Changes to registered information
- 1. The member will promptly contact the Company when there is a change in name, address, or other member information submitted to the Company.
- 2. The Company bears no responsibility for any loss as a result of unregistered changes. Moreover, members should be aware that transactions that have already been made at the time a change is registered will be based on the information before the change.
Article 6: Canceling membership
The cancellation procedure must always be performed by the member wishing to cancel membership. Once the designated procedure for canceling membership is completed, the membership is canceled.
Article 7: Forfeit of membership qualification and obligation for compensation
- 1. If a member submits false information when applying for membership, neglects mail order payment obligations, or behaves in a way that for any other reason is considered by the Company to be inappropriate member behavior, the Company reserves the right to cancel membership.
- 2. A member is responsible for any damages caused to the Company as a result of the following actions.
(1) Improper use of membership number and password.
(2) Accessing the Company's website with the intention of disrupting the Company's ability to conduct business by altering information, transmitting a harmful computer program to the website, or any other malicious actions.
(3) Violating the intellectual property rights of a Company product.
(4) Other actions that violate this Agreement.
Article 8: Handling member information
- 1. As a rule, the Company does not disclose member information to third parties without the prior consent of the member. In the following cases, however, the Company may disclose member information without the member's prior consent.
(1) When required by law to disclose member information.
(2) When the Company determines that disclosing such information is necessary to protect the Company's rights, revenues, reputation, etc. - 2. The Company controls member information in accordance with the Company's privacy policy. The Company may use member information within the Company to provide member services, improve services, promote the use of services, and ensure the soundness and smooth operation of services.
- 3. The Company may send information (including advertisements) to members through phones, direct mails and email newsletters and by other means. If a member does not want to be sent information, the member can use the method prescribed by the Company to inform the Company to stop sending information. The sending of information essential to the provision of services, however, cannot be stopped at the member's discretion.
- 4. We collect and use information for the following purposes:
- To improve the quality of customer service
- To personalize the services we provide based on the user’s experience
- To improve and optimize this web site
- To process payments
- For e-mail notifications - 5. We also provide services through the third party providers below.
- Payment
We accept payments made by credit card, PayPal, and UnionPay, and comply with PCI DSS. PCI DSS (Payment Card Industry Security Standard) is a strict industry standard of security requirements for the handling of credit card data
- Shipment
For overseas shipments, we utilize FedEx, SF Express, EMS, SAL, and surface mail. For domestic shipments (within Japan), we utilize Yamato Transport.
These third party operators do not retain, share, manage, or use personal information for purposes other than fulfilling orders.
- 6. We use officially licensed malware and virus scanning software.
Members’ personal information is maintained behind a secured network. Only a limited number of personnel with special access privileges to this system can access it, and they are bound by confidentiality obligations. All information provided by Members is encrypted using SSL (Secure Sockets Layer). - 7. Data retention
Excluding where required or authorized by law to retain information for longer periods of time, Member personal information is only retained for the length of time reasonably needed to achieve the purposes stated in our privacy policy.
Article 9: Cookies

We make use of cookies on this site.

Article 10: Prohibited items
Members are not allowed to engage in any of following actions when using the Company's services.
- 1. Violating the law or the provisions in this Agreement, or violating warnings regarding the use of services or purchase of products through the services, or violating other provisions
- 2. Harming the rights, revenue, reputation, etc. of the Company or of a third party
- 3. Action that has, or is at risk of being, a harmful influence on young people, or behavior in violation of public morals
- 4. Nuisance behavior that causes discomfort or inconvenience among other users or third parties
- 5. Entering false information
- 6. Transmitting or uploading harmful computer programs or emails
- 7. Improperly accessing the Company server or other computer equipment
- 8. Loaning or transferring passwords to a third party or sharing passwords with a third party
- 9. Behavior not included in the above that the Company determines to be improper
Article 11: Suspending and terminating services
1. I n order to ensure the smooth operation of services, the Company may discontinue part or all of the services without prior notice if any of the following circumstances occur.
(1) When periodic or emergency system maintenance is necessary
(2) The system is overloaded
(3) System operation is disrupted by a disaster, power failure, or interference by a third party
(4) Conditions not included in the above that the Company determines require discontinuation of system operation
Article 12: Changing or discontinuing services
Based on the Company's judgment, the Company can implement appropriate partial or complete changes to, or discontinuation of, its services without prior notice.
Article 13: Disclaimer
- 1. The Company is not responsible in any way whatsoever for loss or damage related to the services it provides its members caused by service suspension, slowing, stoppage or loss of data due to telecommunication, computer, or other equipment breakdown, or from the improper access of data, or any other reason.
- 2. The Company cannot guarantee that computer viruses or other malicious content are not contained within email content sent from the Company's website, server or domain.
- 3. The Company is not responsible in any way whatsoever for any loss or damage that occurs as a result of a member violating the terms of this Agreement or other provisions.
- 4. Content on this site may contain links to third-party web sites. Our firm waives all liability for how privacy is handled on external web sites. Before submitting your personal information to a third party web site, we suggest reviewing their privacy policy.
Article 14: Revisions to this Agreement
The Company reserves the right to revise this Agreement at its discretion. Moreover, the Company may establish provisions supplementary to this Agreement ("Supplementary Provisions"). Revisions to this Agreement or Supplementary Provisions go into force after the revised Agreement or Supplementary Provisions are posted on the site designated by the Company for this purpose. For members, the latest revised Agreement or Supplementary Provisions are the agreement in force.
Article 15: Applicable laws and court of jurisdiction
- 1. The construction, validity, performance and interpretation of this Agreement shall be governed by the laws of Japan.
- 2. In the event that a dispute arises concerning this Agreement, the court of exclusive jurisdiction is the district court with jurisdiction over the region where the Company head office is located.
